Information you will need during the bankruptcy process.

Your lawyer will need the name and address for all of your creditors. Even for debts that you still intend to pay, such as your car and your house. If you don’t know all of that, get your credit report. You can get a free credit report at www.annualcreditreport.com. You will also need your pay stubs for the last 6 months, and your most recently filed tax return.

Filing the bankruptcy case in court.

The bankruptcy case filing will consist of paperwork listing all your debts, all of your assets, a schedule of your income, a list of your monthly living expenses, and your answers to certain questions concerning your financial affairs. If you have an experienced bankruptcy lawyer, the paperwork will be very doable.

What comes next and how long should it take to finish the whole bankruptcy process to a happy ending.

A hearing will take place about one month after your case papers are filed with the court. The hearing will be conducted by a bankruptcy trustee. The hearing for a simple bankruptcy case will take only a few minutes. At the hearing the trustee will ask to see your driver’s license and Social Security card. In my law firm we always send a lawyer with you to the hearing, even for a simple case. Some lawyers will send you there by yourself. We don’t do that, because you never know what might come up. We think you should always have a lawyer there with you.
